USER AGREEMENT

OUR RELATIONSHIP WITH YOU ("THE CUSTOMER")
Webcarhire.com:

• Negotiates rates with its car rental partners to extend these offers directly to customers.
  
• Provides a car rental quotation in the currency of the country of rental.
  
• On your behalf makes a rental reservation with the car rental company and confirms all such reservations with you.
  
• Requires a payment from you to confirm your car rental reservation.
  

YOUR RELATIONSHIP WITH THE CAR RENTAL COMPANY:

• You enter into a contract directly with the car rental company.
  
• The balance of the rental charge is to be paid by you directly to the car rental company when collecting the vehicle.
  
• Unless otherwise stated, the car rental quotation includes all local taxes and charges.
  

CHANGE OF RESERVATION:
Our service enables you to change your reservation details - see "modification".

Car rental documents:
Webcarhire.com:

• Will electronically provide complete rental documentation on completion of your car rental reservation. This documentation must be retained and presented to the car rental company upon collection of the vehicle.
  
• Will not be responsible for car rentals not provided upon the basis of the non-presentation of the documentation supplied.
• Your car rental documentation is stored on and available directly from our web site at www.webcarhire.com. To retrieve your rental documentation you can log in and view your existing bookings under the "My Account" section.
  

Payment for car rental:

• Your payment to make a booking must be paid to us via a valid credit card, no other form of payment can be accepted. The following credit cards are accepted:
  Visa, MasterCard.  Diners Club is only accepted for AUD (Australian) bookings.
  
• The balance of car rental charges is to be paid directly to the car rental company at the time of collection of the vehicle and as detailed in the reservation documentation provided by us. Payment is required to be made with a valid credit card.
  

Modification of booking:

• Changing your booking details may incur extra charges.
  
• You may extend your booking prior to pickup by having additional days added to your rental. To obtain the same rate as the car rental reservation then it must be arranged by us, not through the car rental company.
• If you wish to extend once the rental has begun, this will need to be done directly with the car rental company. In this instance we cannot guarantee you will receive the same rate as what you have booked at.
  
• There will be no refund allowable in respect to modifications of bookings, even where a total balance would otherwise be less than the original booking cost.
  
• In the event that a booking modification results in a higher total balance payable, then you are to pay an additional amount to us, being the difference between the original payment and the new payment.

Cancellation of car rental reservation:

• Cancelling your booking may incur extra charges.
  
• No refund of the amount paid to www.webcarhire.com will be made unless cancellation protection is purchased in accordance with the next section - "cancellation protection".

Cancellation protection:

• You may purchase cancellation protection in accordance with the rates set out below in the event that your car rental reservation is cancelled at least 48 hours prior to the due date for collection.
  
• To obtain cancellation protection you must purchase cancellation protection and pay for it at the time of making the original booking.
  
• You are not entitled to any refund for a car rental being concluded early, for the late collection of the car, for not collecting the car or cancelling your car rental after the commencement of such rental.
  

Cancellation protection rates:

Right of car rental company to refuse to provide car for rental:
All of the car rental companies reserve the right to decline to provide a vehicle to any customer who is, in their opinion, unfit to drive, or does not meet eligibility requirements. In such circumstances, your contract with us will terminate immediately and we will have no further liability to you, nor will you be entitled to a refund of any part of your deposit.

Suitability of rental car:

• All vehicle descriptions, images and representations are indicative only and are subject to change and availability without notice.
  
• Car rental companies reserve the right to substitute a vehicle based on availability and no claim shall be made in respect to the exercise of the discretion of a car rental company substituting such vehicle.
  
• The customer takes full responsibility for the choice and selection of the vehicle which is being reserved, including the suitability of the purpose for which it is being rented.
• You are responsible for deciding if the vehicle is large enough to fit the proposed number of passengers and the appropriate amount of luggage.
  

Disclaimer of liability:

• The information which we present is supplied to us by individual car rental companies and is always subject to change without notice, therefore we cannot accept responsibility for any changes beyond our control.
  
• Upon collection of your vehicle you enter into a direct contract with the car rental company and in the event of any issues, problems, queries, concerns or complaints they should be directed directly to the car rental company with whom you enter into a contract.
  

Agreement with car rental company:

• You will be requested to sign an agreement with a car rental company when collecting your car and it is your responsibility to ensure that the rental details on such agreement accord with the rental documentation supplied by us to you.
  
• You are responsible for any additional purchases debited to your credit card after the rental agreement has been supplied.
  

Other general terms and conditions:

• All car rental bookings are subject to this user agreement and the making of bookings via webcarhire.com is acknowledged by you as being bound by such agreement.
  
• No other terms, conditions or warranties, expressed or implied by law, custom or dealing with us shall form any part of any contract between us and you unless specifically made in writing by us addressed to you.
  
• The terms and conditions of this user agreement shall be deemed to be modified and/or varied by any provision of any legislation or regulation which negates or modifies any provision of this agreement.
  
• You acknowledge that in making a booking with webcarhire.com that you do so on the basis of the material contained on the site and subject to this agreement and you acknowledge that any statement or representation by webcarhire.com, its employees or agents have not been relied upon other than as may be specifically set out on our site.
• The rental of any vehicle will be subject to the law of the country in which it is supplied to you.
  
• You should satisfy yourself that you understand and agree to the terms of a rental contract entered into and you should be aware that you will be subject to and must comply with the terms of such agreement and with the law as applicable at such place from time to time.
  
• We do not except liability for any charges incurred by you with your authority or otherwise.
  
• We reserve the right to levy any government increase in local taxes that may be introduced after the publication of this site, however, we will make every effort to ensure that you are notified of any of these matters either prior to your booking or as soon as practicable after we have knowledge of such increases.
  
• Any additional charges payable upon arrival by you at the time of collection of the vehicle are subject to local taxes at the prevailing rate from time to time in that country.
  
• Apart from any conditions contained in any rental agreement with the car rental supplier you will be held responsible for anyone driving under the influence of alcohol or drugs, causing wilful damage, driving off road, or driving negligently and/or without due care or attention or in breach of any road laws and you agree to indemnify webcarhire.com against any claim or demand whatsoever in respect to any breach of this condition.
  
• There may be restrictions as to the availability of vehicles at peak times.
  
• All cars and all offers are subject to availability and all information including prices is correct, to the best of our knowledge, at the time of publication.
  
• You may have certain statutory and legal rights as a consumer and the terms and conditions of the user agreement are to be read subject to such rights
