USER AGREEMENT

OUR RELATIONSHIP WITH YOU ("THE CUSTOMER")
Webcarhire.com:

  • Negotiates rates with its car rental partners to extend these offers directly to customers.

  • On your behalf makes a rental reservation with the car rental company and confirms all such reservations with you.

  • In some instances requires a payment from you to confirm your car rental reservation.

  • Restrictions can apply when crossing country/state borders, therefore please ensure you advise our Customer Care Centre at the time of booking if you plan to cross countries/borders. Additional Fees may apply

YOUR RELATIONSHIP WITH THE CAR RENTAL COMPANY:

  • You enter into a contract directly with the car rental company.

  • The amount of the rental charge (as per your car rental quotation) is to be paid by you directly to the car rental company when collecting the vehicle.

  • The car rental quotation always states the rental inclusions and exclusions.

  • All extra add-ons, will attract additional percentage taxes and surcharges.

  • It is the driver's responsibility to ensure that he/she has the appropriate driving licence.

CAR RENTAL DOCUMENTS

  • Webcarhire.com will electronically provide complete rental documentation on completion of your car rental reservation. This documentation must be retained and presented to the car rental company upon collection of the vehicle.

  • Webcarhire.com will not be responsible for car rentals not provided upon the basis of the non-presentation of the documentation supplied.

PAYMENT FOR CAR RENTAL:

  • Should we require a deposit payment to make a booking, it must be paid to webcarhire.com with a valid credit card. No other form of payment is accepted. The following credit cards are accepted: Visa, MasterCard. Diners Club is only accepted for AUD (Australian) bookings. Some debit cards may be accepted.

  • The specified amount of the car rental charge (not including additional and/or optional extras) is to be paid directly to the car rental company at the time of collection of the vehicle and as detailed in the reservation documentation provided by webcarhire.com.

  • At the time of vehicle collection, there must be sufficient funds available on the nominated credit card to cover all applicable rental charges and security deposits. The nominated driver and credit card holder need to be in the same name and be present upon collection of the vehicle. Your rental documentation will contain more information relevant to the car hire company with respect to the use of cash or debit cards. All credit card fees charged are additional.

  • Cash deposits are rarely accepted by car rental companies.

CAR RENTAL AMENDMENTS:

  • Any amendment to a booking will be recalculated based on the availability and the rates, at the time the amendment is made. This may be greater or lesser than the rental rate originally confirmed. Amending your booking details can also incur extra charges.

  • You may extend your booking prior to pick up by having additional days added to your rental. However we cannot guarantee you will receive the same rate as what you have booked.

  • If you wish to extend once the rental has begun, this will need to be done directly with the car rental company. We cannot guarantee you will receive the same rate as what you have booked.

  • There will be no refund provided in respect to booking amendments, even where a total balance would otherwise be less than the original booking rate.

  • In the event that a booking amendment results in a higher total balance payable, then you are to pay an additional amount to webcarhire.com, being the difference between the original payment and the new payment.

CAR RENTAL CANCELLATIONS:

  • Cancelling your car rental reservation may incur extra charges.

  • You are not entitled to any refund for a car rental being concluded early, for the late collection of the car, for not collecting the car or cancelling your car rental after the commencement of such rental.

  • No refunds will be given for rentals rejected due to non-production of a driving licence or non-disclosed points. Faxed or photocopied licences are not acceptable.

  • No refund of the amount paid to webcarhire.com will be made unless cancellation protection is purchased in accordance with the next section - "Cancellation Protection".

  • You must purchase Cancellation Protection at the time of making the original booking.

Cancellation Protection - by purchasing Cancellation Protection you are able to cancel your booking with webcarhire.com up to 24 hours prior to pick up of the rental vehicle. You will then be entitled to the refund of your payment made to webcarhire.com to make the booking (less the Cancellation Protection Fee and Processing Fee). An additional charge will be incurred for this service and the cost varies depending on which country you are picking up the vehicle in. Please refer to the table below:

PURCHASING ALLIANZ GLOBAL ASSISTANCE INSURANCE THROUGH WEBCARHIRE.COM:

  • Please refer to the Product Disclosure Statement (PDS) for the terms and conditions related to the purchase of Allianz Global Assistance insurance through webcarhire.com

ADDITIONAL REQUIREMENTS:

  • Please include any additional requirements you may have at the time of making the booking.

  • Child seats are mandatory in most countries and must be requested prior to the pick up date. In the instance that they can not be confirmed, it is recommended that you take your own. Additional charges for child/booster seats are to be paid direct to the car rental company upon collection of the vehicle

  • GPS Units, roof racks, ski racks, snow chains, etc are available from most locations and must be requested prior to the pick up date. These optional extras are subject to availability and therefore are on a request basis only and can not always be guaranteed or confirmed. Additional charges for these items are to be paid direct to the car rental company upon collection of the vehicle.

SUITABILITY OF THE RENTAL VEHICLE:

  • Webcarhire.com is unable to guarantee a particular make or model of a vehicle. The vehicle shown on our website and your car rental documentation is for guidance only. We do guarantee that you will receive a vehicle in the car group that you have booked.

  • All vehicle descriptions, images and representations are indicative only and are subject to change and availability without notice.

  • Car rental companies reserve the right to substitute a vehicle based on availability and no claim shall be made in respect to the exercise of the discretion of a car rental company substituting such vehicle.

  • The customer takes full responsibility for the choice and selection of the vehicle which is being reserved, including the suitability of the purpose for which it is being rented.

  • You are responsible for deciding if the vehicle is large enough to fit the proposed number of passengers and the appropriate amount of luggage.

DISCLAIMER OF LIABILITY:

  • The information which we present is supplied to us by individual car rental companies and is always subject to change without notice. Therefore webcarhire.com cannot accept responsibility for any changes beyond our control.

  • Upon collection of your vehicle you enter into a direct contract with the car rental company and in the event of any issues, problems, queries, concerns or complaints they should be directed directly to the car rental company with whom you enter into a contract.

AGREEMENT WITH CAR RENTAL COMPANY:

  • You will be requested to sign a rental agreement with a car rental company when collecting your vehicle and it is your responsibility to ensure that the rental details on such agreement accord with the rental documentation supplied by webcarhire.com to you.

  • You are responsible for any additional purchases debited to your credit card after the rental agreement has been supplied.

RIGHT OF THE CAR RENTAL COMPANY TO REFUSE TO PROVIDE THE VEHICLE FOR RENTAL:

  • All car rental companies reserve the right to decline to provide a vehicle to any customer who is, in their opinion, unfit to drive, or does not meet eligibility requirements. In such circumstances, your contract with webcarhire.com will terminate immediately and we will have no further liability to you, nor will you be entitled to a refund of any part of your payment made to secure the booking.

OTHER GENERAL TERMS AND CONDITIONS:

  • All car rental bookings are subject to this user agreement and the making of bookings via webcarhire.com is acknowledged by you as being bound by such agreement.

  • No other terms, conditions or warranties, expressed or implied by law, custom or dealing with us shall form any part of any contract between us and you unless specifically made in writing by us addressed to you.

  • The terms and conditions of this user agreement shall be deemed to be modified and/or varied by any provision of any legislation or regulation which negates or modifies any provision of this agreement.

  • You acknowledge that in making a booking with webcarhire.com that you do so on the basis of the material contained on the site and subject to this agreement and you acknowledge that any statement or representation by webcarhire.com, its employees or agents have not been relied upon other than as may be specifically set out on our site.

  • The rental of any vehicle will be subject to the law of the country in which it is supplied to you.

  • You should satisfy yourself that you understand and agree to the terms of a rental contract entered into and you should be aware that you will be subject to and must comply with the terms of such agreement and with the law as applicable at such place from time to time.

  • We do not except liability for any charges incurred by you with your authority or otherwise.

  • We reserve the right to levy any government increase in local taxes that may be introduced after the publication of this site, however, we will make every effort to ensure that you are notified of any of these matters either prior to your booking or as soon as practicable after we have knowledge of such increases.

  • Any additional charges payable upon arrival by you at the time of collection of the vehicle are subject to local taxes at the prevailing rate in that country.

  • Apart from any conditions contained in any rental agreement with the car rental company you will be held responsible for anyone driving under the influence of alcohol or drugs, causing wilful damage, driving off road, or driving negligently and/or without due care or attention or in breach of any road laws and you agree to indemnify webcarhire.com against any claim or demand whatsoever in respect to any breach of this condition.

  • There may be restrictions as to the availability of vehicles at peak times.

  • All vehicles and all offers are subject to availability and all information including prices is correct, to the best of our knowledge, at the time of publication.

  • You may have certain statutory and legal rights as a consumer and the terms and conditions of the user agreement are to be read subject to such rights.
